Something I had to think long and hard about but I’ve decided to move my cycling related uploads to CycleGaz.
With over 1 million video views and nearly 2,000 subscribers, I had the most popular video camera cyclists channel. So why move? Well it’s mostly down to one thing, I’m on my last strike for copyright infringement on the previous channel another one would mean my channel gets closed and i would lose everything.
Even if I kept squeaky clean I could have had a disgruntled driver report a video under their copyright, even thought it isn’t, YouTube hasn’t shown so far that it is will to protect those of us who upload footage of dangerous drivers.
So I would rather not take the risk of losing everything I have by moving everything across now.
I have a few plans for how I can take my channel further, including doing product reviews of cycling accessories and how too videos for setting equipment up.
I’m looking forward to where this new channel can go. Hopefully people enjoy the videos.
I posted before about the use of cameras on the road and the laws behind it. But i feel i missed a few things out that are worth noting. From before we know that the general use of a camera is perfectly legal. The information commissioner confirmed that recording for personal purposes on the road is perfectly fine and that uploading footage to websites like youtube is fine, even if it includes faces or VRNs (Vehicle Registration Number). The information commissioner also confirmed that this is not braking any part of the Data Protection Act.
What about article 8 of the European Convention on Human Rights
Everyone has the right to respect for his private and family life, his home and his correspondence.
Martin Porter wrote about just this, what is more important, the right to privacy or the right to live? Article 2 of the European Convention on Human Rights states
Everyone’s right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.
People have tried to spin this argument against me but the European Convention on Human Rights only applies to a state and not an individual member of the public. Let’s also not forget that the roads are a public place and there should be no expectation of privacy on them.
The Human Rights Act in the UK applies the acts from the European Convention on Human Rights to all members of the public in the UK and not just the state. But again the question is what is more important, life or privacy? The Human Rights Act states
You have the responsibility to respect other people’s rights, and they must respect yours.
How much privacy is actually broken by posting a video online? I would say minimal, everything that is displayed is public information and only friends and relatives can identify the person by their face. There have been no cases so far that relate to this so it is hard to say what the outcome would be in a court of law.
There has been plenty of media coverage about helmet cameras this year already several court cases involving footage from cameras. So far there has not been even a hint from the Police, CPS or any other legal body that using cameras and posting footage of it online is against the law.
For those of you that didn’t see, a few weeks ago a Video Camera Cyclist caught a driver getting out of a vehicle and assaulting another cyclist. Supposedly because the driver passed so close to the cyclist just before a pinch point that his mirror struck him.
It should be an open and shut case but unfortunately the police that took charge of this incident where a bit on the lazy side and gave up when a small challenge was put in front of them. Needless to say the cycling community was up in arms about this and resorted to viral media to get something done about it.
The police originally reported back stating that the owner of the vehicle was not the man in the video and he was not aware who took his vehicle, he was at a wedding and left the keys in his car and it was taken, but apparently returned undamaged and with the keys. Something certainly didn’t add up and why didn’t the police question this further. It’s suspected but never confirmed that the driver at the time was not insured, and if he took the vehicle then is liable for several offences. All of which seem to have been overlooked.
After the clip went viral, local papers picked it up and so did national TV. The driver shortly handed him self into the police and was later fined £400 and order to pay £100 to the victim. Unfortunately his fine was 1/3 of what it should have been, the judge gave him a discount for pleading guilty.
I seriously do question if the driver was insured and if the owner knew about him taking it. If he did then he allowed the person to drive without insurance and prevented the police from completing their investigations. If the driver genuinely didn’t know about the person taking his car then the driver should be charged for taking the vehicle without consent. Unfortunately none of this has been covered by any news sites, I will just have to presume that this has been overlooked. An example of road laws being overlooked by non-traffic police officers.
I was sent a link to this video yesterday morning and at that time it had less than 3,000 views. I gave it a watch and at first it was similar to something I had seen before. But after a while it turned into a classic video that just had me in stitches!
We are lucky in the UK that there is no law regarding cycling in the bicycle lane. The councils can paint all they want and you can just ignore it 🙂
2010 was a long and interesting year for me, I started a youtube channel and a blog about cycling, unfortunately the blog took the back seat as I got some very good results from my videos.
Combined they lead me to have some wonderful experiences with meeting people and getting to know some people who have common goals and interests. It included meeting with several people involved with the Barclays Cycle Superhighway, getting a test ride on the Barclays Cycle Hire bicycles before they came out and meeting the police officers behind the Road Safe London scheme.
My youtube channel has been a great success with over 600 current subscribers. This year alone I have had 410,788 video views. And with that only being my first year, i hope that I can improve on that greatly over the next 12 months ahead.
Towards the end of the year I started a new cycling series called ‘Silly Cyclists’, which is now a regular feature I do. It’s earned nearly 30,000 views in its self and is getting some great feed back.
The last time I rode my bicycle in 2010 was when I had an RTC. At present I don’t want to comment on the incident as there is an ongoing investigation by the police. But I think it shows that these things can happen to anyone.
What will 2011 bring? who is to know, but I wish to continue with my videos and put a bit more emphasis on my blog, so keep checking in to see what I have to say, you never know, one day it might be interesting.
